Company number: BE 0539.874.680

The brand name Airo is owned by Air Management BV.

By placing an order, purchasing a voucher, or reserving a balloon flight, the customer declares to have taken note of these general terms and conditions and accepts them unconditionally.

2. Definitions

In these general terms and conditions, the following definitions apply:

  • Gift voucher: a voucher that entitles the holder to reserve a balloon flight for the number of persons specified on the voucher, within its validity period.
  • Value voucher: a voucher with a monetary value that can be used wholly or partially as payment for a balloon flight or other services from Air Management BV.
  • Reservation: the final booking of a balloon flight via Airo.
  • Passenger: any person participating in the balloon flight.

3. Gift vouchers and value vouchers

3.1 Gift vouchers

A gift voucher entitles the holder to make a reservation for a balloon flight within a validity period of 2 years.
The voucher is only valid for the number of persons specified on it.

3.2 Value vouchers

A value voucher represents a monetary value that can be used as full or partial payment for a reservation. It also has a validity period of 2 years.

If the value of the reservation is higher than the value of the voucher, the difference must be paid. If the value voucher is higher than the reservation, the balance will not be refunded.

3.3 Validity

After the expiration of the validity date, the voucher automatically becomes void, unless Air Management BV expressly decides otherwise in writing.

4. Reservation

Reservations can only be made via www.airo.be.

When making a reservation, passengers may be asked to provide their weight. This information is necessary for safe flight planning.

Incorrect or deliberately false information may result in refusal of participation without the right to a refund.

5. Execution of the balloon flight

Balloon flights take place at sunrise or sunset.
Airo organizes shared flights from its fixed take-off locations, including:

  • Ypres
  • Bruges
  • Roeselare
  • Kortrijk
  • Tournai

Unless a private flight has been expressly booked.

A hot air balloon is an aircraft without a steering mechanism. The pilot solely determines the safe flight direction based on weather conditions. Therefore, no route, landing site, or destination can be guaranteed.

6. Weather conditions

The safety of passengers always has absolute priority.
Balloon flights are entirely dependent on weather conditions.
The pilot solely decides whether a balloon flight can take place safely.
If a balloon flight is postponed or canceled due to weather conditions, a new reservation can be made. Weather conditions that may lead to cancellation include:

  • wind;
  • rain;
  • thunder;
  • fog;
  • limited visibility;
  • technical safety reasons;
  • or other circumstances that may affect safety,

A weather cancellation does not entitle to compensation or refund.

7. Cancellation by the customer

A reservation can be changed or canceled free of charge up to 48 hours before the scheduled balloon flight.

In case of cancellation less than 48 hours before the appointment, late arrival, or no-show, the reservation is forfeited and the used voucher is considered fully utilized.

8. Participation conditions

Passengers must:

  • strictly follow the safety instructions of the pilot;
  • be sufficiently mobile to independently get in and out of the basket;
  • remain standing during the entire landing;
  • not be under the influence of alcohol or drugs.

The pilot may refuse a passenger if safety would be compromised.

A balloon flight is not recommended for persons:

  • who are pregnant;
  • with serious back, neck, or joint problems;
  • who have recently undergone surgery;
  • for whom participation poses a medical risk.

In case of doubt, the participant is advised to consult a doctor in advance.

10. Minors

Minors may only participate under the supervision of a parent or legal representative, unless Air Management BV confirms otherwise in writing in advance.

The minimum body height is usually around 1.20 meters so that one can safely look over the edge of the basket.

11. Safety

The pilot has the final say on all safety decisions during the entire activity.

Every participant agrees to follow all instructions immediately.

If a passenger endangers their own safety or that of others, participation may be refused or terminated immediately without refund.

12. Liability

Air Management BV is solely liable within the limits of applicable Belgian law and the mandatory insurance for aviation activities.

Air Management BV is not liable for:

  • weather conditions;
  • delays;
  • lost or damaged personal belongings;
  • indirect damage;
  • consequential damage.

Valuable items are taken at one's own risk.

13. Photos and video material

During the balloon flight, photos or video footage may be taken.

These may be used for promotional purposes on the website and social media  of Air Management, unless the participant expressly objects in advance.

14. Gift vouchers and refunds

Gift vouchers and value vouchers:

  • are not redeemable for cash;
  • are not refundable;
  • can only be used according to their validity conditions.

Loss or theft of a voucher does not automatically entitle one to a replacement.

15. Payment terms

All invoices are payable within 10 calendar days after the invoice date, unless the parties have agreed in writing to a different payment term.

In the event of total or partial non-payment of an invoice on the due date, default interest is due by operation of law and without prior notice, equal to the statutory interest rate increased by 2%.

Furthermore, the debtor is, by operation of law and without prior notice, liable for a flat-rate compensation amounting to 10% of the unpaid invoice amount, with a minimum of EUR 50.00, without prejudice to the creditor's right to claim compensation for actual damages incurred to the extent that they exceed the flat-rate compensation.

In the event of non-payment of one invoice on the due date, all outstanding, even non-due invoices become immediately payable, without prejudice to the creditor's right to suspend the performance of their obligations or to terminate the agreement in whole or in part in accordance with Book 5 of the Civil Code.

Payments will always first be applied to the owed costs, then to the overdue interest, and finally to the principal amount, regardless of any contrary notification from the debtor.

If any provision of this article is found to be wholly or partially void, unenforceable, or incompatible with mandatory Belgian law, the remainder of this article shall remain in effect and the relevant provision shall be deemed to be replaced by a valid provision that closely approximates its economic purpose.

16. Force majeure

Air Management BV cannot be held liable for delays or cancellations due to force majeure, including but not limited to:

  • extreme weather conditions;
  • government measures;
  • strikes;
  • pandemics;
  • technical defects;
  • unforeseen safety reasons.

17. Privacy

Personal data is processed in accordance with applicable privacy legislation and the GDPR.

More information can be found in the privacy statement at www.airo.be.

18. Applicable law

All agreements are exclusively governed by Belgian law.

Disputes fall under the jurisdiction of the courts of the judicial district where Air Management BV has its registered office, unless mandatory legal provisions provide otherwise.
